Whether crypto has legal status in Côte d’Ivoire depends on the activity involved. Holding Bitcoin for personal use, regularly selling it to clients, accepting a commercial payment or pooling savings from acquaintances do not automatically fall under the same rules.
Ivorian law already distinguishes virtual asset service providers, while the BCEAO is also preparing a specific regional framework. This guide explains how to classify a personal transaction, verify an intermediary’s claims and prepare the necessary supporting documents. It does not replace individualized legal advice, nor does it treat the absence of a simple answer as a general permission.
In brief
- Personal holdings, payments and professional services must be assessed separately.
- An accessible platform does not prove local authorization or a public guarantee on funds.
- For a commercial activity or third-party funds, obtain a written classification before starting.
Crypto legality in Côte d’Ivoire: start with the actual activity
The guide to crypto in Côte d’Ivoire sets out the broader context. The first legal check is then to describe exactly what the user intends to do. Asking “can I use crypto?” combines situations that require different evidence and can lead to a misleading answer.
Consider four hypothetical cases. An employee wants to hold a small amount of Bitcoin. A developer receives an offer to be paid in stablecoins. A merchant wants to buy and resell tokens for customers. An individual promises neighbors a return and pools their deposits. The asset involved alone does not make these transactions legally identical.
The third case is closer to a service provided to others; the fourth adds the collection of funds and a financial promise. Their treatment cannot be inferred from a personal purchase completed without incident. To obtain useful advice, specify the frequency, beneficiaries, commissions, custody arrangements and commitments made to participants.
Ivorian Ordinance No. 2023-875 published by CENTIF-CI provides in Article 58 for prior authorization for the professional activity of virtual asset service provider. This provision should not be turned into a claim that every private holding requires the same approval.
Conversely, it prevents professional service provision from being presented as an unregulated space. An individual who becomes an intermediary does not automatically retain the status of a private user simply because they use a personal phone. The economic reality of the activity matters more than the name chosen for a social media page.
Before making any commitment, prepare a one-page description: personal funds or third-party funds, acquisition or custody, local payment or international transfer, occasional or organized activity. This document makes it easier for a lawyer to assess the situation and avoids seeking abstract approval for “the blockchain.” A serious answer must address the arrangement described, not a slogan.
Do not confuse legal tender with an accepted contract
A digital asset does not become official currency because a seller agrees to accept it. Legal tender concerns monetary status; accepting an asset under a private arrangement raises different questions. An invoice, debt settlement and accounting obligations require analysis that cannot be reduced to the parties’ technical agreement.
The BCEAO explains the conditions for issuing electronic money in WAEMU. This framework does not automatically classify every stablecoin as authorized electronic money. A functional similarity—for example, the ability to transfer value from a phone—does not confer the same legal status.
For a developer paid by a foreign client, several points require clarification: the parties’ residence, the contract, the amount invoiced, conversion, proof of payment and reporting obligations. A transfer recorded on a blockchain may show that assets moved, but it does not by itself establish the transaction’s economic purpose. Linking the contract and invoice to the payment therefore remains essential.
The guide to WAEMU crypto rules helps place the transaction in the regional context. However, general information does not replace Ivorian law or the conditions of the chosen payment service. Compliance with one component does not automatically make the entire process compliant, especially when it crosses a border.
A business should not advertise “crypto payments accepted” solely because an app is available. Request an assessment of the exact service, any intermediary role and the required formalities. The answer may depend on whether the business receives an asset for its own product or organizes exchanges for several clients.
In practice, rejecting an arrangement that cannot be explained is safer than relying on a verbal agreement. If the parties cannot define the beneficiary, the value used and when the debt will be considered settled, the issue goes beyond the choice of token. A clear written agreement and professional review can prevent disagreement after the transaction.
Examine what an authorization actually covers
A brand may offer a crypto platform, a payment service and several contracting companies depending on the country. Users must identify which entity provides the service they need. A well-known logo or a license displayed in a footer does not automatically show which entity holds their funds or which territory the authorization covers.
The list of payment institutions authorized by the BCEAO concerns payment services. It should not be used as a general list of authorized crypto platforms. Checking the scope is the first step before drawing a conclusion from an official registration.
Commercial registration demonstrates legal existence under its applicable conditions, not necessarily the right to hold the public’s digital assets. Nor does an anti-money-laundering registration become a repayment guarantee. For each piece of evidence, request the legal name, number, authority, date and activities expressly covered.
The guide to comparing crypto platforms in Africa sets out this approach. A statement such as “we comply with all laws” provides less information than a verifiable document. Without identifying the entity and service, the customer cannot know where to file a complaint or which evidence to check.
A platform’s absence from a list with a different scope is not enough to conclude that it is illegal. Conversely, the absence of an easily accessible register does not justify assigning it a favorable status. Record exactly what was verified, what remains uncertain and which question requires an answer from the authority or legal counsel.
Individuals must also distinguish between the functions offered through the same interface. The ability to buy an asset does not automatically validate a credit offer, yield product or asset-management activity for others. Each additional function may change the risk and legal classification. Do not treat the entire product range as authorized because one function appears to be available.
Prepare supporting documents without inventing crypto tax rules
A useful transaction file links the source of funds, purchase, transfers and any subsequent sale. It may include statements, contracts, invoices, order IDs and blockchain references. These documents do not make an activity legal on their own, but they help explain a flow and avoid relying solely on a balance screenshot.
Tax treatment must be assessed according to the individual’s personal and professional circumstances. A serious guide cannot announce a single national rate for every crypto transaction without the appropriate legal text and classification. Business income, gains from a transaction and an intermediary’s commissions raise different questions. Seek an answer based on the case described rather than a figure found in an international ranking.
For a commercial activity, record the contract amount and currency, payment date, rate used for accounting entries and fees actually incurred. This preparation allows the accountant to work from verifiable information. It does not determine in advance the applicable tax regime or formalities, which may depend on the transaction.
The guide to KYC and data controls explains why a provider may request additional information. Respond through an official channel and provide the necessary documents without handing over wallet secrets. A compliance requirement never justifies a request for a recovery phrase or PIN.
Ivory Coast’s personal data law is listed among the ARTCI reference texts. Data rights must be considered alongside retention obligations that may apply to the provider. Do not promise that a simple message will necessarily result in the immediate deletion of all regulatory records.
An inconsistency between the account holder, payer and beneficiary may raise questions even when the transaction began with legitimate intentions. Explaining the flow is better than concealing it with a false description or splitting it across several accounts. If the process cannot be described accurately, pause the transaction and clarify the conditions before proceeding.
Ask the right questions before a sensitive transaction
Professional advice becomes useful when it answers concrete questions. Does the activity require authorization? Which company provides each service? Does the contract allow the contemplated transaction? Which supporting documents must be retained? Does this specific arrangement involve foreign-exchange, reporting, accounting or data-protection obligations?
The BCEAO announced in May 2026 a committee tasked with developing the framework for crypto-assets. An announcement that work is under way does not, by itself, constitute an authorization applicable to every provider. Users should follow the documents actually published, their effective dates and their scope.
For a professional seller, a vague answer from commercial support does not replace a review of the relevant laws and formalities. Request a written document identifying the activity under consideration and its limits. A consultation based on incomplete facts may leave custody, collection or international payments outside the analysis.
For an individual, checks can remain proportionate to the project, without inventing unnecessary procedures. A first personal purchase and an exchange business do not require the same file. The goal is to identify sensitive areas before acting, not to turn every technical question into a complex professional process.
If a problem arises, keep the communications and identify the responsible layer. A payment issue concerns a different party from a dispute over token delivery. The contract, service contact details and order references make a complaint easier. Do not wait for an incident to discover that the contracting company was never identified.
Crypto in Côte d’Ivoire cannot therefore be reduced to a universal “yes” or “no.” A reliable approach starts with the actual activity, matches the evidence to the correct scope and obtains professional advice when clients, a business or sensitive flows are involved. The availability of an app replaces none of these steps.
