Crypto regulation in Côte d’Ivoire cannot be verified with a single screenshot of an authorization. A service may combine asset exchange, custody, CFA franc collection and personal-data processing. Each function requires the right qualification and supporting evidence, particularly when a company acts on behalf of clients.
Ivorian legislation already includes provisions for virtual-asset service providers, while the regional framework continues to evolve. This guide offers an assessment method for entrepreneurs, compliance officers and business partners. It separates documented requirements from questions that still need confirmation, as well as operational decisions that should not be postponed until after an incident.
In brief
- Map the service’s actual functions before looking for an authorization or register.
- Evidence relating to payments does not automatically cover crypto-asset exchange or custody.
- Document responsibilities, flows, data and remedies before accepting client funds.
Crypto regulation in Côte d’Ivoire: map the service
The BrefCrypto dossier on Côte d’Ivoire outlines the market and its context. For a professional activity, start instead with a functional map: who receives the funds, who executes the exchange, who controls the keys and who must return the assets to the client? A single interface may conceal several companies and contracts.
A company that only provides software does not necessarily play the same role as an operator that holds the keys. A merchant selling its own products should not automatically be treated as an exchange intermediary. However, marketing language is not enough: the powers actually exercised over the funds must be described precisely.
In a hypothetical setup, an Ivorian application collects requests, a partner receives the XOF and another company holds the tokens. The client sees a single brand, but the case may involve three separate actors. The audit must follow the flow between them rather than focusing only on the reputation of the first name displayed.
The Ordinance No. 2023-875 of November 23, 2023 makes the professional activity of a virtual-asset service provider subject to prior authorization under Article 58. Article 59 requires compliance with the relevant anti-money-laundering and counter-terrorist-financing provisions. These requirements must be reviewed before launch, not after the first complaint.
This reading does not automatically identify the authority, procedure and documents applicable to every specific arrangement. The entrepreneur must obtain confirmation regarding the planned functions and their territory. Difficulty finding a public form does not justify concluding that a professional activity can begin without authorization or legal analysis.
The service profile should specify the assets, currencies, countries, client categories, expected volumes and partners involved. Add the operations contemplated in the event of an outage or contractual breakdown. This exercise sometimes reveals that a simple “withdrawal feature” is actually an additional service that was not included in the initial file.
Link each authorization document to its scope
An authorization must be linked to an identified company and a defined service. Record the legal name, number, authority, decision date and stated limitations. Also check whether the authorization remains valid and applies to the territory where clients will be served, rather than copying a document belonging to a foreign partner.
The BCEAO Instruction No. 001-01-2024 on payment services covers a separate area. A project using a payment partner must examine that component without presenting the partner’s authorization as a universal right to provide crypto services. Contractual responsibilities must reflect the same separation.
The BCEAO list of licensed payment institutions as of August 31, 2026 can be used to check certain names within that scope. A company’s inclusion does not validate every product marketed under its brand. Likewise, the absence of a name from an irrelevant list does not support a conclusion without further review.
The guide to crypto platforms, their criteria and their statuses helps structure this review. Classifying documents into three categories avoids confusion: legal existence, service authorization and operational evidence. A commercial-register extract, a regulatory decision and a security report provide different types of information.
A partnership should be confirmed by the parties, together with the service covered and the related responsibilities. An integration visible in an application does not show that every use imagined by a distributor has been approved. Request the restrictions on clients, countries, assets and flows before using the partner’s name in a public promise.
Maintaining an evidence register also makes it possible to track changes. Each entry should include the source, consultation date, retained document and the limited conclusion it supports. When a contract or provider changes, review the relevant function again. An old verification should not remain valid indefinitely out of habit.
Build a control framework that matches the flows
Compliance is not limited to photographing an identity document. An activity must be able to explain which clients it accepts, which risks it screens for and which transactions trigger additional checks. Procedures must match the services actually provided, without claiming sophisticated controls that the team cannot apply or document.
The BrefCrypto guide to KYC in Africa provides a basis for understanding identification and requests for supporting documents. In a professional project, have the due-diligence rules, internal responsibilities and any required reporting reviewed by qualified specialists. Do not infer specific obligations from a threshold found in foreign documentation.
A test scenario might involve inconsistent identity information, a payment from a third party or a transaction whose origin remains unexplained. Describe who reviews the alert, which documents are requested and how the decision is recorded. These tests should use fictitious data and must not trigger real client movements to test the organization.
The CENTIF-CI page on its powers and obligations identifies its role in the national framework. The team must know the competent contact and applicable procedures without publishing details that could facilitate the circumvention of controls. A reporting obligation should not be confused with an ordinary customer-service procedure.
Flow controls must also take partners’ responsibilities into account. If the company assumes that the payment provider checks everything while the provider assumes that the crypto platform handles every alert, a gap emerges. Contracts and procedures must specify the allocation of responsibilities, permitted information sharing and situations requiring a joint decision.
A refusal policy should remain explainable and proportionate to the applicable rules. Sales teams must not promise automatic account opening or suggest using a false identity to resolve a blockage. Documenting a refusal or an additional request protects the consistency of the framework and facilitates review by authorized contacts.
Protect data and separate client assets
A service may hold sensitive data even when it does not custody private keys. Identity documents, contact details, payment references and information about the origin of funds must be inventoried. Describing their purpose, authorized access, technical providers and applicable retention periods helps prevent documents from being collected simply because they might be useful one day.
The personal-data law presented in ARTCI’s reference texts must be incorporated into the local analysis. Have any formalities and potential data transfers confirmed based on the arrangement. Technical hosting abroad does not automatically remove the responsibilities of an operator serving people in Côte d’Ivoire.
Asset custody requires a separate map. Identify who can sign a transaction, reset access or change a withdrawal address. The guide to wallets and key security highlights the differences between personal control and entrusted custody. For a company, these distinctions must be reflected in contracts and emergency procedures.
Proof of reserves does not answer every question. It is necessary to examine commitments to clients, asset segregation, powers of disposition and return arrangements. A technical balance observed on a given day does not, by itself, establish how assets would be treated in the event of insolvency or a dispute.
Tests should include a withdrawal request, a partner outage and the departure of an internal manager. Who can keep the service running without sharing secrets through a messaging app? Who informs clients? Which operations are suspended? A serious continuity procedure describes limitations, not merely a promise of permanent availability.
Restricting access and keeping useful records makes it possible to investigate an anomaly. These measures must respect confidentiality and applicable retention periods. An overly detailed log can itself expose sensitive information; no log makes it impossible to understand the incident. The design must balance traceability, necessity and protection, with appropriate validation for the service.
Track the rules without confusing announcements with entry into force
The BCEAO said in May 2026 that a committee is preparing the framework for crypto-assets. A project should monitor effective publications and identify their consequences. A conference, consultation and instruction that has entered into force are different stages; none can replace the others as proof of authorization.
The FATF follow-up reports on Côte d’Ivoire provide insight into the anti-money-laundering framework. They do not constitute an individual license for a company. Reviewing their date and purpose helps prevent a national compliance improvement from being used as validation for a commercial product.
An organization can maintain a monitoring calendar covering legislation, contracts, authorizations and new offerings. Each change should be linked to a function and a decision: maintain, adapt, suspend or seek clarification. Monitoring without an owner or processing deadline merely accumulates links without reducing the service’s risks.
Before launch, assemble a file containing the functional description, opinions obtained, verified evidence, contracts and tested procedures. Significant uncertainties should remain visible. A legal response limited to personal asset exchange cannot be reused for an organized custody activity serving several hundred clients.
Public communications must reflect this file. Avoid saying “crypto licensed” when a document covers only a payment service, and do not promise guaranteed restitution without a demonstrated mechanism. Withdrawal terms, the role of partners and the limits of recourse must be clearly stated, rather than forcing clients to discover this information after making a deposit.
An evolving regulatory environment therefore requires a lasting method: qualify each function, verify the right evidence, allocate responsibilities and monitor changes. For a provider in Côte d’Ivoire, the priority is not to find a reassuring logo. It is to demonstrate, before accepting other people’s funds, the basis on which the service operates and how its obligations will be met.
