Crypto Legality in Guinea: What to Check Before Taking Action

The question of whether crypto is legal in Guinea often combines several issues: legal tender, personal ownership, regular sales and raising funds for clients. A single answer can turn a legal nuance into a blanket permission. The right approach is to identify the activity, the parties and the flows before checking the relevant texts.

Guinea’s anti-money-laundering law, published by the BCRG, contains specific provisions on virtual asset service providers. These provisions offer a verifiable reference point, but they do not certify any company encountered online. This guide distinguishes available evidence from conclusions that require appropriate legal advice or administrative confirmation.

In brief

  • Article 101 of the reviewed text requires BCRG approval or authorization for professional VASP activity.
  • A payment status, company registration or foreign license does not automatically prove that the service offered in Guinea is authorized.
  • Claims concerning private ownership, payments or taxation must be assessed separately; no universal conclusion can be drawn from a single term.

Crypto legality in Guinea: separating the questions

A comparison of crypto platforms and their legal statuses helps distinguish technical availability from the right to provide a service. Downloading an application does not prove that a financial activity is authorized. Conversely, the absence of legal-tender status for an asset does not, by itself, answer every question about its ownership or transfer.

Legal tender concerns the monetary function recognized by law. Ownership concerns the fact of holding an asset. Professional intermediation focuses on a service offered to clients. Raising funds or managing money on behalf of others creates additional issues. These distinctions prevent a statement intended for a commercial service from being applied to every possible situation.

The anti-money-laundering text published by the BCRG defines VASPs in Article 6, point 63. It covers activities carried out commercially in the name of or on behalf of a client, including certain exchange, transfer and custody services. The classification therefore depends on the actual functions involved, not just the name chosen for an application.

This guide does not claim to be a consolidated version of all Guinean law. We have not exhaustively reviewed every implementing text, amendment or individual decision. This limitation prevents a reading of one law from becoming a certification of every possible use. Anyone planning to operate a business or handle third-party funds still needs a precise legal analysis.

Conakry, Guinea, must also be distinguished from Guinea-Bissau and Equatorial Guinea. The authorities, currencies and applicable legal frameworks differ. A search that overlooks this distinction may return provisions from another jurisdiction. Check the country and the originating institution before relying on a text as the basis for a local commercial decision.

What the text provides for professional activity

Article 101 of the reviewed document states that no person may professionally provide virtual asset services without approval or authorization from the Central Bank of the Republic of Guinea. It also provides for the identification and sanctioning of people operating without the required status. This is a concrete requirement, not a promotional statement about innovation.

Article 97 assigns the BCRG responsibility for regulating and monitoring compliance with anti-money-laundering and counter-terrorist-financing obligations applicable to VASPs. This supervisory role must be distinguished from the existence of an individual approval. The inclusion of a category in a law does not mean that every company invoking it has obtained the necessary authorization.

Consider two situations: an individual occasionally sells an asset held for their own account, while a company publishes rates, receives client funds daily and decides when those clients can withdraw. These facts have different characteristics. We are not setting an artificial frequency or amount threshold here that would automatically turn the first activity into a professional service.

A project must examine who exchanges, transfers, holds or administers the assets and the instruments that enable control over them. An interface described merely as a “matching service” may perform other functions in practice. The analysis must follow the actual flows and powers involved, including where several partners operate behind the same visible brand.

No specific provider is endorsed in this article. We do not have a complete, up-to-date list that would allow us to confirm the authorizations claimed by every offer. Ask for an official reference, its scope and the entity it covers. If the answer cannot be matched to independent evidence, record it as “unverified” rather than “authorized by default.”

How to verify claims of approval or public backing

A company may be registered without holding all the financial authorizations it needs. Likewise, a partnership with a payment operator does not guarantee the compliance of every crypto service offered around it. Identify what each document covers, the date involved and the company concerned before assigning it any broader significance.

The Guinean Ministry of Economy and Finance denied a purported crypto investment partnership in November 2024. The case illustrates the risk of institutional impersonation. A logo, signature or document shared in a private group should therefore not be treated as the sole evidence of public backing.

Find the announcement on the official website or authenticated channel of the institution supposedly involved. Check the project’s exact name and what was actually announced. Participation in an event, a meeting or an award does not necessarily amount to authorization to receive funds. The claimed relationship must directly support the specific commercial statement being assessed.

The guide to buying crypto with Mobile Money highlights another limitation: a payment receipt documents a transfer, not the seller’s status or the quality of the token. A known mobile number does not become a repayment guarantee. Keep proof of payment separate from the contract promising delivery.

Foreign licenses require the same level of scrutiny. A document may concern a subsidiary, product or territory different from the one covered by your contract. A global company does not necessarily have the same scope everywhere. Users and professional partners should verify the entity actually responsible instead of treating the group’s reputation as an answer to every local question.

Ownership, data and taxation: avoiding shortcuts

Reviewing the provisions on professional services is not enough to resolve every personal situation. A receipt, sale, payment or cross-border transaction may involve other rules. Do not infer a general permission from the absence of an identified ban in one passage. The nature of the asset does not remove obligations relating to the parties and the activity.

Custody is also a separate choice. The crypto wallet guide explains the difference between controlling personal keys and holding a balance with a custodian. Controlling your keys does not place you outside the law; it mainly changes the technical means of control and the responsibility involved if assets are lost, stolen or transferred incorrectly.

Identity documents should be submitted through a verified channel. The KYC and data-protection guide sets out useful questions about the recipient and the purpose of the collection. Collecting documents does not prove that a service is authorized. You should also refuse to provide login codes or a recovery phrase on the grounds that they are needed to meet an administrative requirement.

As for taxation, no single rule should be taken from a tutorial without an applicable source. We make no claim here about a general rate or an exemption linked to the word crypto. A professional activity, income and a personal resale may require different analyses. A qualified adviser would need to know your residence, the transactions, the dates and the actual supporting documents.

Keep the records needed to reconstruct the sequence: quotes, beneficiary details, order references, receipts and transaction IDs. Store them separately from confidential secrets. This file may help explain the origin of funds or examine a dispute, without guaranteeing the outcome. A collection of screenshots without a timeline is less useful than a clear link between commitments and movements.

Building a documented decision before sending funds

Prepare a sheet describing the objective, the budget in GNF, the service, the consideration received, custody arrangements and the exit process. Add the available evidence and the unresolved questions. This method separates a personal assumption from a confirmed statement. It also makes legal advice easier, since the adviser can examine a concrete flow rather than an abstract question about crypto as a whole.

Economic cost deserves its own line of review. The guide to crypto fees in Africa helps measure the total debit and net result. A transaction can be legally documented and still be too expensive or unsuitable. Conversely, an exceptional rate does not offset an unknown identity, an unverified authorization or an exit that depends on a promise.

Stop if you are asked to use a false identity, provide a misleading payment purpose or split a transaction to avoid a check. These requests are not ordinary shortcuts. They can weaken the evidence and expose the user to consequences unrelated to the savings advertised on a fee or the time saved during registration.

If a problem occurs, identify the stage and the responsible party before paying again. A mobile-transfer incident, a failure to deliver and a compliance decision do not necessarily involve the same party. Contact official channels with the relevant references. A promise to recover funds in exchange for another payment should be independently verified, not accepted solely because of the urgency.

The question of crypto legality in Guinea therefore requires an answer proportionate to the activity involved. The reviewed text clearly establishes a prior requirement for professional VASP services, but it does not certify any particular offering. The prudent approach is to connect the rules to the facts, verify claimed authorizations and keep uncertainties visible rather than turning them into permission.
