Is Crypto Legal in Sierra Leone? What the 2024 Law Changes

The question of whether crypto is legal in Sierra Leone cannot be answered with a simple yes or no. Buying for personal use, selling professionally, holding clients’ assets and paying for a contract may fall under different rules. A reliable answer must identify the activity before determining which legal provisions apply.

Sierra Leone’s 2024 law on money laundering and illicit financing provides a specific starting point: Article 103 addresses virtual assets and virtual asset service providers. It supports neither the claim that the sector operates in a total legal vacuum nor the idea that all crypto activity is freely permitted. Here is how to read the framework and assess the necessary evidence—without turning this guide into individual legal advice.

In brief

  • Article 103 notably requires the relevant service provider to register and obtain a license before beginning operations.
  • Legal tender, holding assets, making payments and providing a service are separate questions.
  • An old report or a foreign license does not prove a company’s current status in Sierra Leone.

Crypto in Sierra Leone: start by defining the activity

Our comparison framework for crypto platform statuses shows why a product’s name is not enough. You need to know who is acting, on whose behalf, with whose funds and in exchange for what remuneration. Someone buying for themselves and a company collecting money from multiple clients do not automatically perform the same function.

First, describe the process in ordinary language: a client pays in leones, one company buys a token, another holds the keys, and a beneficiary later receives the funds. Each step may require a separate form of oversight. Describing the entire process as “a blockchain transaction” can obscure the contracts and intermediaries that determine responsibility.

Frequency and organization also matter when assessing a professional activity. An individual who becomes a regular seller, charges a margin and moves other people’s funds should not assume that a personal account covers that activity. Seek local advice on the precise legal classification instead of relying on the terminology used by the application.

Finally, separate the question of the asset from the question of funding. Even if an asset may be held, that does not make the use of illicit funds or a borrowed identity lawful. Rules on evidence, payments, anti-money laundering and customer protection do not disappear because delivery takes place through a distributed ledger.

To prepare a useful request, gather the proposed contract, amounts, countries involved, parties and payment methods. A general question sent to commercial support is likely to produce a general answer. A factual description allows a qualified professional to check the relevant authorizations and any applicable limits in your case.

What Article 103 of the 2024 law actually provides

The text of the law published by the Financial Intelligence Agency contains a section titled “Virtual assets.” Article 103 notably requires the actors covered by the provision to assess the risks of money laundering, terrorist financing and proliferation financing. Its approach therefore does not ignore virtual assets.

Paragraph 3 provides that the relevant provider must take measures to identify and manage those risks, register and obtain a license before starting operations. It also addresses the secure transmission of information about the originator and beneficiary of transfers to the entities concerned, as well as the availability of that information to competent authorities.

Paragraph 4 provides for criminal penalties in the event of a violation of paragraph 3. This provision calls for a professional reading of the full text, rather than the shortcut that a small activity or a foreign application must necessarily fall outside the framework. We do not infer from it an automatic penalty applicable to every private holding of cryptocurrency.

Other paragraphs address the people controlling providers, supervision and cooperation. The article must be read alongside the law’s definitions and other relevant obligations. An alleged approval does not remove the need to understand the scope of the services provided, while a KYC procedure does not replace an operating authorization where one is required.

The GIABA follow-up report published in 2024 confirms the existence of this framework in its analysis of Recommendation 15. However, it assesses progress through 15 May 2024. Its observations on licenses or monitoring tools are not an up-to-date inventory of operators authorized in October 2026.

Why legal tender and the right to use a service are different questions

Legal tender concerns currency and the circumstances in which it must be accepted under applicable law. The ability to hold an asset or enter into a contract is a separate matter. None of the texts reviewed for this guide supports presenting Bitcoin or USDT as a national currency recognized on the same basis as the leone.

The BSL notice of 20 August 2019 on prices and payments recalls provisions on expressing prices in leones and describes restrictions concerning foreign currencies. On its own, the document does not provide an exhaustive classification of every payment made in virtual assets. It does, however, prevent the assumption that an agreement between two people overrides all local monetary rules.

For an invoice or contract, have the account currency, settlement currency, any required permissions and the conditions imposed by intermediaries reviewed. Do not infer from an international dollar-denominated price that local billing is permitted in any unit. The distinction remains important for a business, lease or professional service.

Mobile payments do not provide a general authorization for crypto either. Our guide to Mobile Money and cryptocurrency purchases distinguishes the transfer of money from the delivery of the token. The presence of an operator and the ability to open an account do not prove that every use proposed by a seller complies with its terms of service.

In practice, request a written, targeted answer for the proposed process, particularly when it involves a cross-border payment or client funds. Reject solutions based on false residency, an invented payment purpose or a borrowed identity. They add inconsistencies rather than resolving the original legal question.

How to verify a license, identity and available remedy

Usable proof of authorization connects an identifiable company to an authority, a document, a period and specific activities. A regulator’s logo does not establish that link. Check the exact name, address, any reference number and scope, then confirm the information through an official source independent of the seller when public information is insufficient.

Company registration demonstrates, at most, a fact of legal existence within its own scope. A foreign license may cover a service elsewhere without automatically authorizing the same activity in Sierra Leone. Likewise, participation in a technical experiment does not necessarily amount to a permanent commercial authorization. Ask what the document actually authorizes, not merely whether it appears official.

KYC identity checks and their limits require the same level of precision. Who collects your documents, for what purpose, for how long and with what remedies? Claimed compliance must not be used as a pretext to obtain your private keys or recovery phrase. Those elements provide access power, not ordinary proof of identity.

Before making a deposit, also identify the complaints channel and the stated contractual law. The existence of a remedy guarantees neither speed nor recovery of a claim. An insolvent or difficult-to-identify intermediary can make the process costly. Preparing the documents does not eliminate that risk; it merely avoids starting a dispute without a contract or supporting references.

Our overview of crypto custody and wallets points out that technical risk adds to legal risk. A company may publish detailed terms without properly securing its systems. Conversely, a functioning wallet does not prove that a professional service meets the obligations attached to its operation.

Build a file before acting, not after a freeze

For an individual, the minimum file should include the provider’s identity, dated terms, proof of payment, the exact asset, network and quantity received. Add the fees and intended exit route. Our method for calculating crypto costs helps distinguish the economic result from the headline price, without confusing compliance with profitability.

A professional must go further: classify the activities, identify the required authorizations, allocate partner responsibilities, establish customer controls and manage incidents. Using an external provider does not eliminate all of the professional’s own obligations. A competent local firm can determine which additional rules apply and what steps are required before launching or expanding the service.

Date every response received and keep the question that accompanied it. An authority or lawyer may have answered a specific function without approving a broader activity. If the model later changes—for example, by adding custody of client funds or a foreign partner—have the change reviewed rather than silently extending the scope of an earlier response.

Do not assume a tax exemption simply because no crypto rate appears in a tutorial. Income, commissions or gains may require analysis under the relevant rules and circumstances. Keep monetary units clear, particularly when an older document uses the former leones. An accountant needs facts and supporting documents, not an isolated final balance.

This guide documents texts consulted on 15 October 2026 and does not provide a certified list of licenses currently issued. A new directive or a decision concerning an operator may change the analysis of a specific process. The practical conclusion remains the same: define the activity, verify official evidence and obtain an answer tailored to the situation before entrusting funds or offering a service to others.
