The question of whether crypto is legal in Chad rarely calls for a serious yes-or-no answer. Holding an asset, funding its purchase through a supervised institution, offering it to clients and issuing an investment product are different activities. A rule applying to one cannot automatically serve as a verdict on all the others.
The sound approach is to distinguish legal tender, COBAC’s banking perimeter and the services overseen by COSUMAF. This guide examines that method using identifiable regional sources. It does not provide individual legal advice, authorization to buy, or a tax conclusion applicable to every situation in Chad.
In brief
- The BEAC CFA franc is the legal tender of the union to which Chad belongs; Bitcoin does not acquire that status simply because a merchant accepts it.
- The restrictions recalled by COBAC apply to its supervisory perimeter and must be taken seriously when arranging payments.
- A regional framework for digital-asset service providers does not prove that a specific seller holds the necessary authorizations.
Crypto legality in Chad: asking the right question
Our method for checking platform status starts with the activity and the actor. Legal research should do the same. Replacing “am I allowed to use crypto?” with a description of the proposed activity makes it possible to seek a useful answer: who is doing what, for whom, with which funds and through which service?
Consider four hypothetical situations: an individual holds a private key, a company receives a payment, a professional buys assets for clients and a platform holds their tokens. These situations share technical vocabulary, but not necessarily the same obligations. An answer concerning the first does not validate any of the other three.
Location matters too. The client’s residence, the company’s establishment, the beneficiary’s country and the destination of the funds may bring several sets of rules into play. A foreign license must not be presented as general permission to operate in Chad. Its scope, holder and covered services require separate verification.
The date of a document matters as much as its title. A consultation draft, a statement, an adopted regulation and an implementing instruction do not serve the same purpose. A screenshot of an old article without a link to the underlying text cannot establish what applies today. The version consulted should be retained, along with its limitations.
The goal is not to accumulate references to create an impression of safety. It is to identify the rules that may change the practical decision: an authorized account, a regulated service, required documents or a payment restriction. If a key question remains open, the project should wait for appropriate clarification rather than rely on a commercially favorable interpretation.
Legal tender cannot be inferred from private use
The BEAC describes the currency of the Central African Monetary Union and its note-issuing privilege. Chad belongs to that union. The Central African CFA franc therefore provides the official monetary reference; a digital asset displayed in an app does not become legal tender because of its popularity or because its value is shown in francs.
Our guide to the two CFA francs helps put this framework into context. Using the XAF code avoids mistakenly importing a rule or service from the XOF area. Linguistic similarity or the same peg to the euro does not merge the institutions, payment actors and procedures of the two zones.
Legal tender must be distinguished from an agreement between private parties. The fact that a seller accepts an asset in one transaction does not resolve every question involving invoicing, foreign exchange, taxation or customer protection. Nor does the technical ability to transfer an asset authorize anyone to present it as equivalent to a guaranteed bank deposit.
The same reasoning applies to stablecoins. A sought-after peg to the dollar describes an economic mechanism, not official recognition in Chad. The issuer’s commitments and redemption rights must be assessed in the issuer’s own documents. A dollar logo does not demonstrate public backing or an automatic right to receive banknotes.
For a merchant, the practical question may concern the unit of invoicing and proof of settlement. For an individual, it may involve acquiring an asset and exiting the position. In both cases, the documentation must describe the actual flow. Hiding the nature of a transaction behind an ordinary label complicates the analysis and may create additional contractual or regulatory problems.
Reading COBAC restrictions within their scope
The official statement from the May 6, 2022 session recalls several prohibitions related to crypto assets and regulated institutions. This regional banking source cannot be dismissed simply because a payment goes through. It requires an examination of how supervised institutions are involved in financing and settling the transaction.
Conversely, isolating one sentence to announce that every individual holder necessarily commits an offense goes beyond what this single statement can establish. Determining a person’s status and conduct requires additional elements. A cautious guide must distinguish the scope of the source consulted from the legal conclusion being sought.
The framework is not limited to a traditional bank account. The status of the monetary service provider being used and the rules relevant to its services must be identified. Presenting a mobile transfer as a general way around banking restrictions would be misleading. The absence of visible involvement by a branch does not eliminate the electronic-money issuer or its obligations.
Our Mobile Money and crypto purchases guide explains how the mechanism works; it does not create a local exemption. Before a transaction, confirmation must concern the specific case and come from the competent actors. A commercial agent or token seller cannot change the terms of a payment account through a promise.
A refusal by the intermediary should lead to suspending the process, not artificially splitting the amounts or using a third party. Such practices often make it harder to link the documents properly and may create inconsistencies in the source of funds. A sound legal position rests on transparent facts; it is not built around ways to conceal them.
Checking the service and COSUMAF authorization
COSUMAF lists digital-asset services among the activities of its intermediaries. This professional category makes it necessary to examine the actual services offered, including buying and selling on behalf of others, custody and platform operation. It does not turn a restricted banking activity into a service free of conditions, nor does it validate any particular brand.
Ask for the full legal name, the cited number, the authorization document and the service it covers. The public authorization-checking system is a starting point. An incomplete screen or a search with no result does not, on its own, prove a universal absence of authorization; official confirmation may still be necessary.
A company may display an authentic business registration without holding the authorization corresponding to the service it sells. It may also fall under a foreign authority for certain activities only. Comparing the holder, territory and product precisely helps avoid confusing a company’s legal existence with its right to hold or exchange assets for the clients concerned.
Our guide to crypto identity checks also notes that a request for supporting documents does not prove licensing. Fraudsters can imitate a serious process to collect documents. Status verification should therefore come before sending sensitive information and should use a channel independent of the one provided by the person soliciting the documents.
Older COSUMAF PDF pages presented access limitations during this research. Official indexed excerpts and the current presentation help identify the professional framework, but they do not replace a consolidated review of all texts and amendments. We therefore infer neither an exhaustive list of authorized providers nor universal quantified requirements here.
Preparing a useful request for clarification
Describing a transaction step by step produces a better answer than asking a general question. State the person’s status, country of residence, currency, proposed amount, beneficiary and objective. For a commercial activity, also specify who holds the keys, who sets the price and who bears the risk of a payment or delivery error.
Attach the relevant contractual terms and keep dated responses. A qualified professional can then identify the issues involving payments, investment, cross-border dealings, anti-money-laundering requirements and taxation, as applicable. This guide assigns no Chadian tax rate because no consolidated basis verified for all possible situations is available.
Understanding how crypto wallets work helps explain custody in this context. Saying only “we have an app” leaves the essential question of control over the funds unanswered. A company that can sign transactions for its clients is not engaged in the same activity as a software provider with no access to their keys.
The advice received should lead to a decision: proceed under conditions, genuinely modify the project or withdraw. Changing the wording of an advertisement without changing the flows does not solve a fundamental problem. A prudent framework should also be reassessed when a new service, a different partner or a change of territory is introduced. Documenting these steps helps show what was actually checked, by whom and when.
The useful conclusion for Chad therefore cannot be reduced to a slogan of general authorization or prohibition. It lies in a documented characterization of the transaction and the parties involved. Until the monetary process, service status or essential obligations are clear, no technical convenience justifies presenting the project as legally validated.
