For entrepreneurs, the priority is to prepare a clear file covering money flows, asset control, the companies involved and customer rights. This guide sets out a methodical preparation process based on the identifiable regional framework. It does not replace a legal assessment of the project, an administrative authorization or a full review of the applicable national and regional texts.
In brief
- Describing the service’s actual functions helps identify the relevant rules; the commercial name is not enough.
- Separating custody, payments, conversion and advice prevents the assumption that one authorization automatically covers every activity.
- Planning compliance, incident management and restitution before recruiting customers costs less than improvising a system after funds have been blocked.
Crypto regulation in Chad: start with the flows
Our guide to crypto platform criteria and legal statuses provides a basis for identifying the relevant players. For a new project, map the path of every value: who receives the XAF, who buys the token, where it goes and who can move it afterward. The map must reflect actual practice, not just stated intentions.
A company that transmits an instruction without holding funds does not necessarily play the same role as one that collects funds and then delivers them. An interface can nevertheless conceal actual technical custody. If the team holds the keys or can modify withdrawal instructions, that capability must appear in the analysis and in the explanations provided to customers.
Also identify the economic beneficiaries, partners and territories involved. A provider based abroad may participate in a service delivered to residents of Chad. That structure does not remove the need to verify local obligations. The location of the server answers neither the question of applicable law nor that of contractual liability.
For each function, record a responsible party and supporting evidence: a partner agreement, technical procedure, internal authorization or cited license. A line without supporting documentation signals that verification is still required. Terms such as “automated” or “decentralized” do not replace these documents when a team sets prices, holds keys or controls access to withdrawals.
Conclude this first stage with a written scope. What the service will not do matters as much as what it plans to do. Actually excluding custody or advice can change the project; excluding them only in a clause while the practice includes them solves nothing. Consistency between the contract, the technology and communications must be demonstrable.
Distinguish banking supervision from digital services
The COBAC statement of May 6, 2022 calls for particular vigilance regarding the involvement of regulated institutions in crypto-asset transactions. A monetary partner should not be assumed to be available simply because its interface accepts a transfer. Obtaining approval appropriate to the planned flow must come before any commercial promise.
COSUMAF describes digital-asset service providers within its intermediation framework. Custody, buying and selling, and operating a platform raise specific questions. This framework helps identify an authority and a scope to examine; it does not automatically authorize every company that uses a blockchain.
Ask precisely which service the authorization covers and which company holds it. A business registration or software license does not prove a right to hold customers’ assets. A partnership with an authorized entity must also specify what that entity actually does and what remains the project owner’s responsibility.
The public COSUMAF license verification tool can help begin the process. The access limitations affecting the documents and registers encountered in this research make it impossible to provide an exhaustive, up-to-date list of all authorizations here. Before handling customer funds, official confirmation and a legal review of the consolidated texts remain necessary.
Do not infer from a professional framework that banking restrictions disappear. The two must be aligned with the actual customer journey. A company may understand the regulatory category of its activity while having no authorized monetary partner to finance it. In that case, the architecture must be reviewed before launch, not completed with personal accounts.
Build a proportionate data and control framework
The guide to KYC checks and remedies emphasizes the need to verify identity and source of funds according to the service. For a business, this requires defined responsibilities, a collection policy, retention conditions and restricted access. Stacking copies of identity documents in a shared mailbox is not an organized system.
Every piece of data must serve an identified purpose. Who requests it, who reviews it, who can correct it and how long should it be retained under the applicable obligations? This guide sets no universal legal retention period for Chad. It recommends having the precise requirements determined, then translating them into verifiable procedures that employees and customers can understand.
Plan for refusals and enhanced reviews: inconsistent identity information, a payment from a third party, a changed beneficiary or insufficient supporting evidence. Employees must know how to suspend a transaction and refer it to the appropriate manager without making up an answer. A sales procedure must never encourage staff to artificially change the reason for a transaction or split flows to avoid a check.
Technical records should enable reconstruction without exposing secrets. Recording an order reference, a decision and a transaction identifier may help; logging a customer’s recovery phrase, by contrast, creates a major danger. Access to logs itself requires management, protection and a review of how they are used.
Test controls before opening with fictional scenarios and non-sensitive data. A demo account, an intentionally incomplete document or an inconsistent payment reference can help verify the expected response. Testing must not create a real false identity, a deceptive transaction or customer funds committed without authorization.
Organize custody, incident management and restitution
The distinction between a crypto wallet and crypto custody becomes an organizational issue when several people work in the company. Who can prepare, approve and sign a transfer? What happens if someone leaves the team? A single key held by a founder can expose all customers to that person’s unavailability.
Define permissions, backups and recovery procedures with qualified specialists. A sophisticated mechanism that is poorly understood may be less reliable than a simpler organization with proper controls. The goal is to reduce excessive powers and errors while preserving the ability to return assets in accordance with customers’ rights.
Prepare an incident and response register covering misdirected transfers, network outages, compromised access, balance discrepancies, unavailable partners and disputed withdrawal requests. Each scenario should specify who decides, which evidence must be retained and how the customer will be informed. Avoid guaranteed timelines when delivery depends on a third party or an uncontrolled network.
Separating assets and their accounting under the applicable framework requires serious analysis. A global balance on a blockchain does not prove that each customer has clearly identified rights. Reconciliation between the internal ledger, available assets and contractual obligations must make it possible to detect a shortfall, not merely produce a reassuring commercial table.
The service’s closure must also be planned. Define the conditions for restitution, the points of contact and the information to maintain in the event of a shutdown. A responsible company does not build only its onboarding process. It also prepares for voluntary departure, the end of a partnership and the consequences of a suspension, without making remedies dependent on a temporary messaging group.
Check economic viability without sacrificing the rules
Calculating total crypto costs matters to entrepreneurs as well. A commercial margin must cover the services actually delivered, partners, security and request processing. A model that works only by removing controls or holding funds longer than announced has a structural weakness.
Purely fictional management example: 400 monthly transactions generating a gross margin of 900 XAF each represent 360,000 XAF before expenses. If relevant expenses reach 500,000 XAF, the monthly deficit is 140,000 XAF. No return promised to customers should be used to conceal this imbalance or finance an obligation that is already due.
Correctly identifying the XAF helps ensure that quotes, invoices and contracts use unambiguous monetary terms. For international flows, add a review of foreign-exchange rules, commercial documentation and tax treatment. No improvised rate or threshold can replace validation applicable to the structure and its operations.
Finally, compile a decision file covering the approved scope, confirmed partners, identified obligations, successful tests, residual risks and stop conditions. A limited launch does not justify ignoring an essential check. Reducing the number of customers may reduce operational exposure, but it does not turn a regulated activity into an experiment free of conditions.
In Chad, professionalizing a crypto service therefore means starting with rights, responsibilities and flows before building the storefront. The decisive deliverable is not a slogan: it is an understandable customer journey, relevant authorizations that have been verified and a tested ability to return assets. Without those elements, publishing an application does not solve the problem; it makes the problem accessible to customers.
