For entrepreneurs, the priority is to define their activity before choosing the technology. For individuals, it is to understand what the sources establish and what they leave unresolved. Verified on October 19, 2026, this guide offers a framework for reviewing and monitoring the rules; decisions carrying legal consequences require local legal validation tailored to the facts.
In brief
- An activity’s compliance cannot be inferred from either its code or the accessibility of an application.
- The 2026 GIABA report must be read alongside national legislation, without confusing an international assessment with authorization.
- Effective monitoring keeps records of versions, dates, scopes and official responses received.
Crypto regulation in the Comoros: mapping the activities
An analysis should begin with the functions actually being performed. Our guide to regulatory criteria for crypto platforms distinguishes between the brand, the company and the service. In the Comoros, describe custody of funds, exchange, transfers, collection and any lending separately. Combining them in one application does not merge them legally.
An operator that holds clients’ signing keys does not carry the same responsibilities as a software provider offering only a tool. A company that receives funds to execute trades adds a financial relationship. Status must be assessed based on how the service operates, how it is remunerated and the commitments undertaken—not solely on the wording used in its terms and conditions.
The boundary between professional and private activity deserves particular attention. A group that regularly organizes conversions, sets prices and charges a commission cannot simply present itself as a private circle without further examination. An activity may remain small while still triggering obligations. A limited number of users is not, by itself, a demonstrated exemption.
The mapping should also specify the relevant territories. Where does the client live, which company signs the contract, where do the funds arrive and which law does the agreement invoke? A French-language interface and payment in KMF do not answer those questions. The service may fall under several jurisdictions, with overlapping obligations that do not offer the same avenues for redress.
To make this analysis concrete, map the customer journey on paper. For every movement of money or tokens, identify the responsible actor, its role and the available evidence. Any stage without a clearly identified party signals a missing verification. This operational map can then support discussions with lawyers, banks and the relevant authorities.
Placing the rules and their effective dates in context
The BCC’s regulatory page includes references to the 2013 banking law and the 2020 law on payment services. These titles identify areas that require review. They do not establish that a particular crypto activity falls within a specific category or benefits from authorization.
The second 2026 GIABA follow-up report notes a new anti-money-laundering law adopted on June 30, 2025, while continuing to identify gaps relating to virtual assets. Its assessment concerns technical compliance with international recommendations, not authorization for a commercial product. That scope should accompany any reference to the report.
A company must locate the applicable text, its publication and any amendments. A draft law, a call for consultants or a public presentation is not equivalent to a rule that has entered into force. Conversely, continuing to rely on an outdated summary can mean missing a reform that has already been adopted. The date an article was written does not replace the effective date of the cited text.
An authority’s decisions and instructions may clarify how a law is implemented. Their legal basis, addressees and scope must be checked. A rule addressed to supervised institutions does not automatically become a license for every application developer. It may nevertheless influence the checks carried out by banks processing the project’s payments.
A monitoring file should therefore contain four columns: source, date, activity concerned and operational consequence. Add a note whenever the interpretation remains subject to confirmation. This approach makes uncertainties visible instead of hiding them behind a general statement. It also makes it easier to compare a new rule with procedures already in use.
Distinguishing financial authorization, registration and contracts
A company may have an incorporation document without being authorized to conduct a financial activity. A license may also cover a limited service while excluding other functions available through the application. The review must therefore focus on the relationship between the company, the authority and the activity. A certificate screenshot, without independent means of verification, is insufficient evidence.
In December 2025, the Ministry of Finance republished a BCC warning about offshore activities. The publication recalls challenges to banking and financial licenses claimed by certain entities. Its online publication date must be distinguished from the date of the original statement, and the scope of the document being cited must be checked.
For a project, request written confirmation directly from the relevant department. The question should describe the activity, the clients and the planned flows. An abstract question about “blockchain” may receive an abstract answer. A response obtained for a purely technical function must not be reused as validation for taking deposits or offering an investment product.
A contract with a foreign platform does not replace this process. It primarily sets out the provider’s private obligations and the conditions of access. Its clauses cannot create a national authorization that is otherwise missing. A change in the contracting entity or the client’s country of residence may also alter the service’s scope and the available remedies.
Evidence must remain current. An authorization may be suspended, limited or no longer correspond to the commercial name being used. Schedule a review when major changes occur: a new product, a new intermediary, a new country or a new collection method. Compliance is not a file obtained once and then left unchecked.
Turning obligations into concrete controls
Identity checks are not limited to collecting documents. Our guide to KYC checks, privacy and recourse outlines the questions to ask about how that information is used. A professional activity must determine which obligations genuinely apply to it, then organize procedures that are proportionate and traceable.
Money flows should be monitored separately from data flows. Who receives the payment, who can refund it and who keeps the supporting records? Our guide to the links between mobile money and cryptoassets helps break down these steps. A payment operator does not automatically assume the obligations of every other participant in the process.
Technical custody requires its own decisions: access to keys, segregation of funds, incident management and the ability to return assets. Our guide to wallets and custody responsibilities provides the necessary vocabulary. Describing a system as “decentralized” does not explain who actually controls the means of acting on a client’s assets.
A procedure should also define what triggers a suspension and who reviews it. Blocking access without an operational explanation can cause harm, while promising withdrawals without any controls may prove impossible to honor. The process must match the applicable obligations and contractual commitments. It should neither claim unlimited freedom nor invent unsupported formalities.
Commercial communications must meet the same standard of accuracy. Technical availability does not amount to authorization; a stated reserve does not become public insurance; a simulation does not become an expected return. Our guide to the real costs of crypto transactions helps present fees without concealing the spreads built into the price.
Building ongoing monitoring and a decision file
Monitoring should prioritize official publications and preserve the documents actually used. A page may change or disappear. Record the link, consultation date, version and precise conclusion drawn from it. A file containing only social media screenshots makes it difficult to reconstruct a decision after an incident.
Assign each question to a competent point of contact. The status of a financial activity, taxation and data protection may require separate analyses. Asking a single commercial provider for one definitive answer creates an obvious conflict of interest. A professional opinion should also explain its limits and the factual assumptions on which it rests.
A decision register makes the process usable. It should record the issue reviewed, the evidence, the remaining uncertainty, the responsible person and the next review date. A company can then understand why it opened or suspended a function. For an individual, a simplified version is sufficient: entity, authorized service, cost, custody and complaints channel.
Technical changes should trigger a new review when they alter the risk. Adding a network, entrusting keys to a third party or accepting a new category of clients is not merely a change of interface color. Contracts, security and applicable obligations may evolve together. The full set should be checked before launch, not after the first deposits.
Crypto regulation in the Comoros therefore amounts neither to a general ban demonstrated by this guide nor to unrestricted commercial freedom. A robust method is to define the activity, locate the current rules, verify the claimed authorization and document the decision. When an essential element is missing, the appropriate next step is to obtain a targeted answer rather than fill the gap with advertising certainty.
