Crypto in the Central African Republic: What Changed in 2023

Asking whether crypto in the Central African Republic still has the legal status announced in 2022 first requires correcting outdated information. Authorities removed legal-tender status and guaranteed convertibility for cryptoassets in the revised law of April 6, 2023. Presenting an earlier presidential announcement today as a general authorization to buy, make payments or collect savings therefore leads to a misleading interpretation.

That correction does not resolve every individual situation. Holding a private key, receiving a token, financing a transaction through a supervised institution and holding assets for clients raise different questions. For a resident, merchant or entrepreneur in Bangui, the useful approach is to identify the contemplated activity and the documents that can actually be used to assess it.

In brief

  • Revised Law No. 23.005 of April 6, 2023 removed the legal-tender status and guaranteed convertibility previously granted to cryptoassets.
  • Regional banking restrictions and rules governing service providers must be read within their scope, without reaching the same conclusion for every individual.
  • A serious project requires confirmation of its flows, partners and obligations; an accessible app or advertisement is not a substitute for authorization.

Crypto in the Central African Republic: putting the dates in order

Our guide to how to verify crypto platforms recommends comparing commercial claims with dated documents. That method is especially important here: a 2022 video may continue circulating without mentioning the change made the following year. Readers may then mistake an earlier legal position for the current situation.

The first reference is Law No. 22.004 of April 22, 2022. Its revision is identified as Law No. 23.005 of April 6, 2023. The Banque de France monograph describes the reform intended to remove legal-tender status and the convertibility guarantee, followed by the adoption of a revised version in March 2023. The BEAC statement of September 28, 2023 confirms the reference to the April 6 law and welcomes efforts to comply with community rules, while calling for their implementation to be monitored.

Those two removals have practical implications. The first prevents anyone from relying on the former official recognition to claim that a merchant must accept a token. The second prevents anyone from promising, on the same historical basis, that the state will automatically convert a holder’s assets. A private repayment promise requires its own terms, debtor and financial resources.

Distinguishing a parliamentary vote, promulgation and press commentary also helps avoid approximate dates. For documenting the revision, the precise reference remains the law of April 6, 2023. As for any purportedly more recent amendment, it requires an identifiable and verifiable text—not merely a screenshot shared in a discussion group.

This guide does not claim to provide an exhaustive consolidation of all national and community-level provisions. Several official archives had access limitations during the research. The documented timeline is enough to reject the claim that “Bitcoin still has the legal-tender status it received in 2022”; it is not, by itself, enough to answer every question involving commerce, taxation or liability.

Holding, paying and working for clients change the question

An individual holding assets for personal use is not engaged in the same activity as a professional collecting money from dozens of clients. The distinction depends on the operations performed, control of the funds and commitments made. The word “wallet” may refer to personal software or conceal an account managed by a company that holds all the keys.

Our explanation of how crypto wallets work and how to secure them helps describe this distinction without misleading terminology. Who signs a transaction? Which party can suspend withdrawals? Who is responsible for returning the assets if the service closes? Answering these questions provides more information than a slogan about financial freedom or an application’s decentralized nature.

Commercial payments raise other issues: the seller’s identity, the contract, proof of performance, the invoicing currency, refunds and any reporting obligations. A transfer recorded on a blockchain demonstrates a technical movement of funds. It does not prove that the correct creditor received the agreed amount, or that the settlement complies with every applicable rule.

The BEAC CFA franc is the monetary reference for the Central African Republic within its monetary union. Our guide to the difference between XAF and XOF helps avoid importing West African institutions and procedures. A form that simply displays “CFA” may lack precision; that imprecision becomes more problematic when an offering combines several countries and intermediaries.

It is also necessary to distinguish the token itself from the financial contract built around it. Holding an asset and subscribing to a guaranteed-return promise do not involve the same risks. A company claiming that its entire business automatically benefits from an earlier law favorable to Bitcoin is therefore avoiding scrutiny of the service actually being sold.

Banking channels remain subject to their own rules

The COBAC statement from the extraordinary session of May 6, 2022 recalls restrictions related to cryptoassets and regulated institutions. It notably covers holding, exchanging, converting and settling cryptoassets. This regional banking source requires users to verify the payment path rather than assume that a technically possible transaction has necessarily been approved by the intermediary.

The opposite interpretation also calls for caution. This statement alone does not establish that every person holding a private key is automatically committing a criminal offense. The actor’s status, the nature of the activity and other applicable texts remain decisive. Confusing these levels replaces legal analysis with a shortcut.

A mobile-money account is not, simply by virtue of its format, a general exception. Behind the interface are a service provider, contractual terms and compliance obligations. Our guide to buying crypto with Mobile Money explains possible mechanisms without certifying every national payment route. An offer published by a seller does not demonstrate an official partnership with the operator it names.

In practice, requesting a written response about the exact transaction offers more security than asking a vague question about crypto. Specifying the source of funds, beneficiary, purpose and intermediary gives the provider the information it needs. A favorable response concerning an ordinary transfer must not be turned into a disguised authorization for another activity.

A refusal or request for supporting documents should not be bypassed through a nominee, a false explanation or transaction splitting intended to conceal the flow. Such practices create additional inconsistencies and may worsen the situation. The proper step is to pause the process and seek competent clarification, not to make the transaction less visible.

A well-known brand is no substitute for verifying the service

COSUMAF lists digital-asset service providers among the intermediaries within its remit. This category covers professional functions, including buying and selling, custody and platform operation. Its existence does not validate any specific company, nor does it turn a foreign authorization into a universal right to serve Central African clients.

Verification starts with the full legal name, not just the logo. The authorized holder, cited license number, nature of the service, territory and contracting company must all be matched. An authentic document may concern a different subsidiary or an activity that does not include the product actually being offered.

The public verification of a COSUMAF license provides a starting point. If the interface returns incomplete information, requesting official confirmation remains preferable to reaching a definitive conclusion. An unsuccessful search alone does not prove that no authorization exists; nor does a screenshot provided by a promoter constitute independent verification.

Our guide to crypto identity checks and remedies highlights another trap: completing a questionnaire and submitting identification does not guarantee the recipient’s legitimacy. Fraudsters imitate these steps. Before sharing sensitive documents, verify the official channel, why the documents are needed and how they will be stored.

The size of a community or the fame of a promoter does not change this method. A paid recommendation may prove only that a campaign exists. Useful protections come from clear contractual rights, an identifiable responsible party and a practical remedy. Even an authorized service still carries technical and financial risks that a license does not eliminate.

Building a file that leads to a decision

For a personal project, a short summary is often enough to clarify the request: residence, objective, asset, intended amount, source of funds, recipient and exit method. For a professional activity, add the intended clients, custody arrangements, fees, partners and commitments. Precision allows the adviser consulted to identify the relevant questions.

Then classify each document according to its role: official text, provider terms, written response, contract or simple advertisement. This separation prevents a fee schedule from being treated as an authorization or a license as a repayment guarantee. Keeping the dates also helps reassess a decision when a partner, service or document changes.

Tax matters require a specific analysis of the circumstances. This guide provides no universal Central African tax rate or assumed exemption, because no consolidated basis verified for every use case is available. A transaction with no apparent profit may still require supporting records. Keeping a consistent history makes discussions with a qualified professional easier without replacing that professional’s assessment.

Also define what will trigger a new review. Occasional use that becomes a regular activity, custody newly offered to third parties or the addition of a beneficiary country may change the initial questions. The file should not remain frozen simply because an initial trial occurred without incident. Recording changes and asking about their impact before committing additional funds provides more protection than relying on an old answer removed from its context. The same discipline applies when a provider changes its terms or contracting entity.

The conclusion should take an actionable form: proceed with the documented transaction under specified conditions, materially change the project or suspend it pending resolution of an essential issue. Removing one word from an advertisement does not change a fundraising operation. The useful question is therefore not whether all crypto can be labeled “legal,” but whether there is a reasoned answer concerning a specific act.
