Crypto Legality in Burkina Faso: What the Law Provides

Asking whether crypto is legal in Burkina Faso requires a closer look at the activity involved. Holding your own tokens, safeguarding clients’ assets and regularly providing conversion services do not raise the same legal questions. A working website or successful payment does not settle the legal status on its own.

Asking whether crypto is legal in Burkina Faso requires a more precise question: which activity is involved? Holding your own tokens, safeguarding clients’ assets and regularly selling a conversion service are not the same matter. The fact that a website is accessible or a payment goes through does not, by itself, settle the legal status of the activity.

Burkina Faso has a national law covering virtual asset service providers: Law No. 046-2024/ALT of December 30, 2024. Its provisions for professional activities must be considered separately from questions concerning ownership, payments and taxation. This guide explains the distinctions that can be demonstrated, without claiming to provide an exhaustive list of authorized platforms or replacing advice tailored to a specific transaction.

In brief

  • Article 58 requires prior approval or authorization to provide virtual asset services professionally.
  • A rule applicable to a service provider does not amount to a public guarantee of a token or validation of all personal transactions.
  • Service status, payments, taxation and proof of funds require separate checks against the relevant laws and contracts.

How to approach crypto legality in Burkina Faso

Our guide to crypto rules in WAEMU provides the regional framework. In Burkina Faso, however, start by describing the facts: who owns the funds, who controls their movement and who provides a service to whom? Framing the issue this way helps avoid confusing the use of a technology with the practice of a regulated profession. The size of an application does not answer these questions.

Personal ownership concerns assets bought or received for one’s own account. A professional activity may involve converting clients’ funds, transferring their tokens or managing their access. The same buttons may appear in both situations, but the economic structure is different. The language used in an advertisement is not enough to turn a regularly paid service into informal private assistance. The analysis must focus on the service actually performed.

The question “legal or prohibited?” may also concern payment for a product, access to a foreign platform or the reporting of income. An answer about service-provider activity does not automatically resolve all of these issues. If a company invokes an anti-money-laundering law to promise general permission, ask for the precise provision. Recognition of an asset in a legal text does not demonstrate universal authorization for every use.

Our guide to platforms and their legal status distinguishes legal identity from technical availability. A brand may operate through several entities and contracts. The service used by a resident of Burkina Faso must be identified in its terms, together with the activities covered by any claimed authorization. Global reputation or a physical office address does not replace the need to match the legal entity, service and territory concerned.

This approach may sometimes produce a conditional answer rather than a clear green light. It nevertheless has an advantage: the reader can see what is missing. For a professional transaction, local advice based on the contracts and actual flows may clarify the required steps. For a personal purchase, proof of the provider’s status and understandable terms remain useful. This guide does not claim to replace an examination of every individual situation.

Reading the national law and the scope of services

The official text of Law No. 046-2024/ALT, published by the Transitional Legislative Assembly, includes definitions of virtual assets and virtual asset service providers. Its definition of a service provider covers commercial activities carried out for or on behalf of a client. It includes several functions, such as exchange, transfer and custody. The focus must therefore be on the operations, not merely the product’s name.

Article 58 requires prior approval or authorization from the competent authority to operate professionally as a virtual asset service provider. This requirement goes beyond incorporating a company. An operator’s file must establish the relevant status for the services it offers. A commercial registration, payment account or technical partnership addresses different questions. Their existence does not automatically prove that the required professional authorization has been obtained.

Article 59 requires compliance with the relevant provisions, including preventive measures, and provides for specific requirements to be set by the competent authorities. The analysis of the provider’s status must therefore continue with the applicable obligations. A company may describe identity checks without demonstrating that it is authorized. Conversely, a reference to its legal status does not explain how it protects funds, handles incidents or conducts ongoing due diligence.

The law is intended to prevent illicit flows. It does not guarantee a token’s price or promise public reimbursement after a loss. Nor does it allow every application to be treated as authorized simply because it has added a KYC form. The guide to crypto identity checks helps distinguish those checks, the documents submitted and the available avenues for recourse.

The official record of the law in the Assembly’s archives confirms its reference and provides access to the text and preparatory documents. This traceability helps distinguish a national source from an unsupported reproduction. It is not a list of authorized crypto platforms. A legislative archive and permission granted to a company remain two different types of document.

Assessing a claimed authorization and its limits

When a service provider announces that it is authorized, ask for a verifiable reference. The document should identify the authority, entity, date and scope. A photograph of a certificate without a way to trace its source leaves the verification incomplete. Then compare that legal entity with the account agreement. Authorization granted to another company in the same group does not necessarily cover the relationship you are about to enter into.

The BCEAO list of payment institutions as of August 31, 2026 counts two institutions in Burkina Faso. That figure concerns payments, not two authorized crypto exchanges. Using an authentic list outside its scope can lead to a false conclusion. Each actor’s role must be visible in the flow: local payment, conversion, custody and asset transfer.

A foreign license must also be read only for what it demonstrates. It may provide information about an activity or entity in a specific jurisdiction. Without verification, it should not be treated as permission to serve every African market with every product. The presence of a well-known partner in an advertisement does not change that requirement. The client must be able to connect the evidence to the service offered and to the contracting party.

The absence of evidence from a guide does not establish that no authorization could exist. Our research does not provide an exhaustive register of authorized virtual asset service providers. Nevertheless, a provider claiming a particular status should make relevant verification possible. If its response remains vague, that uncertainty may justify postponing the transaction. A documentary limitation in this article must be distinguished from evidence supplied by the company itself.

A technically successful payment does not automatically regularize the service that follows. A monetary operator may process a transfer while the crypto seller assumes a separate obligation. Our guide to buying crypto with Mobile Money outlines these separate responsibilities. A receipt should therefore be read as proof that funds moved, not as evidence that the entire chain following the payment is compliant.

Separating ownership, payments, taxation and cross-border flows

Holding a token is not enough to establish the rules governing a commercial payment. The currency of the price, the contract, the beneficiary and any conversion must be identified. A supplier may request XOF while its client holds units denominated in digital dollars. How the difference is settled requires a concrete analysis. The existence of a wallet does not replace the relevant commercial and monetary terms.

Our guide to XAF and XOF highlights the need to clarify the payment route. Burkina Faso uses XOF within the West African Monetary Union. Rules specific to Central Africa should not be applied automatically. A document concerning another country may be useful for comparison, but it does not become the national reference for your transaction simply because both regions use the term CFA franc.

An international digital transfer may also connect several services. The blockchain records the movement of the token, while the purchase, sale and monetary settlement have their own terms. For a business, the source of funds, the contracting party’s country and the economic purpose should appear in the file. Using a token does not authorize anyone to erase these elements or present every transfer as an activity outside any external framework.

This guide does not establish a Burkinabe crypto tax schedule. Nor does it conclude that there is a general exemption because an advertisement does not mention any tax bearing the name of a token. Income, a commercial activity or a disposal requires classification under the relevant rules. Keep the dates, amounts and exchange rates so that the matter can be reviewed. For an individual situation, seek advice based on your actual transactions.

The method for assessing crypto fees helps establish the economic result without determining its tax classification. The debit, quantity received, network costs and amount recovered should remain separate. A screenshot showing a theoretical gain is not necessarily proof of income actually received. Accounting clarity and legal clarity reinforce each other, but neither replaces the other.

Building a useful file before making a decision

A file can begin with a simple summary: use, amount, entity, contract, service provided and destination of the funds. Add evidence of any claimed status, its sources and the available remedies. If an answer is missing, identify it precisely. This organization makes it possible to request targeted confirmation rather than a general opinion about “crypto.” The professional consulted can then connect the documents to the relevant functions and obligations.

Crypto-asset custody should appear in this summary. Who holds the keys, and who can authorize a withdrawal? An operator that holds clients’ assets performs a different function from software that leaves each user in control of their keys. The application’s visual presentation does not demonstrate its architecture. The contract and actual operation must match the claims made to clients.

Prepare transaction records without exposing secrets. Blockchain identifiers, payment receipts and order histories can help explain a chain of funds. Confidential codes and recovery phrases serve another purpose: accessing or spending funds. They should not become documents sent to a stranger. A compliance request can be reviewed without handing over the means to control a wallet or mobile account.

The questions must evolve with the use case. Buying occasionally for yourself does not yet describe a service provided to clients. Starting to receive their funds, charging for a conversion or managing their keys changes the analysis. Before expanding a project, reassess the status and obligations rather than relying solely on an initial successful transaction. Repeating a technical process does not demonstrate that it is covered by professional legal authorization.

A rigorous answer to the question of crypto legality in Burkina Faso therefore cannot be reduced to a slogan. National law governs professional services, while personal transactions, payments and income require separate questions. The useful decision is to verify the activity, contracting party and appropriate documents. This approach offers more protection than a general green light based on access to an application or a token’s popularity.
