For an entrepreneur, the first useful deliverable is therefore not an advertising campaign. It is a map of the flows and responsibilities, supported by the necessary confirmations. This guide sets out that preparation without certifying any current licensing regime or authorizing a launch. Decisions must be based on the applicable rules and a local review of the model actually being planned.
In brief
- Describe exchange, custody, local currency and transfers separately to identify the relevant compliance questions.
- A registered company, a payment partner and a foreign license do not automatically cover every function.
- The project must plan controls, complaints handling and an orderly shutdown before accepting customer funds.
Crypto regulation in The Gambia: map responsibilities
Our report on platform criteria and legal statuses points out that a brand does not define a legal perimeter. Draw up a map of the project entities: operating company, technology provider, custodian, payment partner and any potential sellers. For each one, specify the contract, territory, service and ability to move a customer’s money or assets.
Then trace a transaction from start to finish. Identify who receives the dalasis and who is responsible for the price. Determine who holds the tokens before delivery, who can suspend an instruction and who handles a refund. The diagram must reflect how the project actually operates, including manual tasks carried out in a messaging app or through an administrator’s personal account.
An arrangement presented as simple matchmaking may conceal significant control. If the project collects money, holds a shared key or promises that an exchange will be completed, it is not enough to describe the code as “decentralized.” Its economic and technical role requires precise classification. Also document possible interventions in the event of an error, as these often reveal the control actually being exercised.
The government page on The Gambia’s central bank provides a starting point for identifying the monetary and financial authority. The project should submit questions within its remit to that authority, with appropriate legal advice. This guide does not anticipate the authority’s response and does not turn an exploratory meeting or correspondence into authorization to operate.
The map must also distinguish company funds, amounts owed to customers and revenue. Mixing them makes it impossible to know the obligations outstanding at any given time. A seemingly positive treasury may include assets that economically belong to third parties. From the design stage, assign an identifier and rationale to every movement so it can later be reconciled.
Verify legal evidence before the first transaction
In its 2022 assessment of The Gambia, GIABA reported a CBG decision not to license virtual-asset service providers seeking to operate in the country. This historical information makes it necessary to verify the current position; it does not establish that a project is authorized today or summarize all Gambian law.
The file should bring together the relevant laws, decisions and contractual terms, along with their dates. Identify what comes from a law in force, a regulation, a draft or an international recommendation. A document proposing a framework does not prove that the framework has been adopted. A recent publication featuring an old text does not automatically change its scope or implementation timetable.
Commercial registration confirms existence under its relevant regime, not every financial permission one might imagine. Likewise, a license held by a partner does not necessarily extend to your company or service. Request an analysis of how functions and obligations are divided. Saying “we use a regulated provider” does not answer the question of what you do yourself.
Tax matters require a separate track with the Gambia Revenue Authority and qualified advisers. Present the revenue model, commissions, assets held and cross-border flows. Do not invent a flat crypto tax rate to simplify a business plan. An unverified classification can distort margins, invoicing and commitments made to customers.
Prepare a table of open questions, assigning each one an owner and a resolution condition. If access to a function depends on confirmation, that function must remain unavailable until confirmation is obtained. A caveat buried in the terms and conditions does not fix a product that is already operating outside the validated perimeter. Compliance must shape how the product works, not just how it is described.
Design controls without collecting unnecessary data
The official presentation of the Financial Intelligence Unit outlines its role in the national framework for combating illicit flows. For your project, obtain confirmation of the obligations that actually apply: identification, due diligence, record-keeping, reporting and points of contact. These questions should neither be ignored nor assigned mechanically to every technical tool.
Our report on KYC, data and recourse highlights that customer checks must also protect the customer. Define what data is necessary, who receives it, which internal teams can access it and how long it is retained. An identity document stored without safeguards in an employee’s messaging account adds risk without demonstrating a serious or properly implemented compliance framework.
The organization must plan for difficult cases: a name mismatch, an illegible document, a third-party beneficiary, an unexplained source of funds or a sudden change in the transaction path. Document the decision, its approval level and the communication sent to the customer. Staff must be able to suspend a transaction without improvising a misleading reason or promising that a control will be lifted when they have no authority to do so.
Confidentiality also places limits on technical logs. Record the references needed for investigation and reconciliation without writing down passwords, one-time codes or recovery phrases. Restrict access and test revocation when someone leaves the project. A large volume of data cannot compensate for a lack of accountability over how it is used.
Monitoring should make it possible to reconstruct a transaction without asking the customer for everything after the fact. Link the order, payment, conversion and delivery through consistent references. If an obligation requires specific retention, have its scope and duration confirmed. Do not choose a universal period simply because a competitor lists one in foreign terms and conditions.
Test financial and technical security together
Wallet security is not limited to storing a key. For a service, it also covers signing rights, approvals, backups and segregation of duties. Ask who could move funds alone, change an address or disable an alert. One person holding all of those powers creates an identifiable weakness.
Where possible, run tests without customer funds: an incorrect amount, an incompatible network, a duplicate payment, an unavailable provider and a lost connection. The system must produce an understandable status, not just a generic message. A confirmed payment followed by uncertain delivery must remain visible as a case to resolve, rather than disappearing from the accounts or being automatically marked complete.
A simple reconciliation example illustrates the issue. Suppose 10,000 units are owed to customers and only 9,930 units are actually controlled at the assigned addresses, with no other explanation. The shortfall is 70 units, or 0.7% of the obligations. This fictional scenario does not describe any company; it shows why a deficit should trigger an investigation even when the percentage appears small and withdrawals continue.
The payment partner may be another point of weakness. Our guide to Mobile Money transaction flows distinguishes its role from that of the asset seller. Obtain written confirmation of the intended use, the accounts involved, the limits and the handling of complaints. A successful technical demonstration does not authorize a use prohibited by the provider’s terms.
Finally, quantify the costs of controls, an operating reserve and incident response. Our analysis of the real costs of crypto transaction flows helps look beyond the visible commission. A model that works only by temporarily reusing customer funds for day-to-day expenses reveals a dangerous dependency. Available cash and amounts owed to users must remain clearly separate.
Prepare for complaints, changes and service shutdown
Before launch, define the official complaints channel and the information required. Customers must be able to report a problem without publishing their documents or secrets. Set out the steps, responsibilities and verified contractual deadlines. Support that responds quickly but cannot identify who is responsible for a decision does not provide an adequate procedure for complex incidents.
An orderly shutdown plan deserves as much attention as the commercial plan. How will funds be returned if a provider stops its service, an account is closed or the project abandons an activity? Plan for withdrawals, communications, reconciliations and evidence retention. The shutdown must not depend entirely on the availability of one executive or a single phone.
Changes should trigger a new analysis: adding a country, currency, asset, partner or custody mechanism. Approval obtained for a limited function does not automatically cover a broader product. Keep the version of the reviewed diagram and compare it with actual operations. This discipline makes changes controllable rather than cumulative and invisible.
For the go/no-go decision, use explicit launch conditions: confirmed scope, compatible partners, tested controls, reconcilable accounting, sufficient funds and a usable incident procedure. An unmet condition must block the relevant function, not become a promise to regularize matters after acquiring customers. This preparation protects the company as much as the people it aims to serve.
Crypto regulation in The Gambia therefore requires documented work before a commercial response. The professional deliverable is not to proclaim a legal vacuum, but to connect every function to evidence and accountability. Until that correspondence is complete, the project may continue its research and testing without customer funds; it must not present that preparation as authorization already obtained.
