Legal Crypto in Burundi: What the Legal Texts Actually Show

The phrase “legal crypto in Burundi” masks several different questions: holding an asset, providing a payment service, holding funds for a third party and operating a platform do not describe the same activity. A serious answer must specify the role, product and evidence cited instead of grouping the entire sector under a single label.

Historical notices from the central bank and the March 2025 anti-money-laundering law provide different reference points. Reading them does not automatically certify a commercial offering. This guide sets out the relevant distinctions without providing individual legal advice or recommending any way around Burundian rules.

In brief

  • The 2019 notice refers to the absence of legal tender status and authorization for virtual-currency payment or money-remittance services.
  • The 2025 law defines virtual-asset service providers within an anti-money-laundering framework; that definition does not amount to a company license.
  • Before carrying out a transaction, request evidence relating to the specific service and the contracting entity—not merely a commercial certificate.

Legal crypto in Burundi: establish the facts before drawing conclusions

Start by explaining what you intend to do: hold assets for yourself, receive a payment or regularly convert clients’ money. Our guide to crypto platforms and the statuses to verify helps identify the relevant roles. An app’s name alone is not enough to classify the activity.

The same technology can support several different relationships. Someone monitoring a public address does not have the same role as a company that receives funds and decides when withdrawals are made. An association collecting money from its members raises yet another set of questions. Friendly terminology does not replace an analysis of the flows.

State who pays, who receives the funds, who holds the keys and who is paid. Add the parties’ places of residence and the value’s final destination. This description enables counsel to address a specific case rather than interpret a general question about blockchain.

Nor should you infer an exemption from the small size of a transaction. A rule may concern the nature of the activity regardless of the amount involved. Artificially splitting a project to avoid verification is not a legal or financial protection strategy.

Our research, current as of October 20, 2026, does not certify the individual status of any provider. It does not resolve every situation involving personal holdings and does not replace a tax analysis. Any conclusion about your transaction must take into account the facts and the rules that actually apply.

What the central bank’s historical notice says

The BRB notice published in 2019 takes a restrictive position on virtual currencies. It notably recalls that they do not have legal-tender status in Burundi and states that, at the time, no entity was authorized to provide the money-remittance or payment services mentioned in the document.

The source’s date and scope must accompany any use of it. It is not a new announcement from 2026. Nor should it be reduced to a general criminal-law statement about every possible form of conduct without identifying the relevant text and facts.

The absence of legal-tender status does not answer exactly the same question as whether a professional is authorized. The first concerns monetary status; the second concerns an activity or service. Mixing the two makes it impossible to understand what a document actually proves.

A seller who claims that the old notice is no longer relevant should provide pertinent evidence, not merely their own interpretation. Ask for the new text, the decision and their respective scope. Repeating a claim across several groups does not give it additional legal force.

Conversely, do not present the absence of recent confirmation as an exhaustive investigation into every decision by the authority. This guide’s finding remains limited: we have not confirmed a locally authorized route to recommend. An appropriate consultation may seek the elements needed for a specific activity.

The 2025 reform must not be turned into a fictitious license

Law No. 1/08 of March 27, 2025 amends the framework for combating money laundering and terrorist financing. Article 3 notably defines virtual-asset service providers as part of a system for identifying and supervising financial activities.

A statutory definition can identify an activity so that obligations can be applied to it. It does not automatically grant every participant a commercial license. To demonstrate that a company has the right to provide a service, the relevant authorization and conditions must be established in addition to the general framework.

Readers should therefore ask which evidence answers which question. The law may document a category; a decision may document the authorization of its holder; a contract describes the client’s rights. None of these elements fully replaces the other two.

A parliamentary communication about a bill may help explain the reform’s objective, but the enacted text remains the reference for its normative content. Do not use a summary formula to announce general legalization if the necessary implementing decisions have not been verified.

Our guide to crypto KYC and document requests also explains why an identification process does not amount to service approval. A website may collect someone’s identity without proving that it is authorized. The presence of a form certifies neither the applicant nor its activity.

Mobile payments, foreign exchange and crypto: verify different categories

The list of payment institutions as of February 9, 2026 distinguishes between players and categories. It notably includes active electronic-money issuers. This list must not be reproduced under the heading of licensed crypto platforms.

Lumicash, EcoCash and Cashtel appear in the electronic-money network covered by the list. Their status in that category does not prove that they market virtual assets. A private announcement offering to settle an exchange by phone introduces another party and another contract.

The guide to mobile money and cryptocurrencies shows why the evidence must be kept separate. A local payment receipt may confirm a debit without confirming delivery of the token. An operator’s responsibility for its own service does not guarantee the promises made by an external seller.

An authorized foreign-exchange bureau also has a scope that must be verified. Do not assume that the right to exchange currencies covers every conversion into cryptoassets. The product, clientele and transactions offered must correspond to the status actually confirmed.

Cost comparisons come only after this step. Our method for assessing fees and the full cost of crypto purchases is designed to help read a quote, not to make an offer acceptable when its status remains uncertain. A lower price does not compensate for missing authorization.

Personal holdings and custody for others: do not improvise

Personal holdings raise questions about the source of funds, assets, security and potentially taxation. This guide does not infer any general exemption from the lack of detail on an internet page. Request an answer tailored to your situation before treating an obligation as nonexistent.

Holding a third party’s keys adds significant practical responsibility. Our guide to crypto wallets and custody explains the difference between personal access and delegated management. Calling it assistance does not eliminate the risk that a relative may depend entirely on your availability.

For a company or group, specify who can sign, who can block a transfer and how rights are transferred. Members’ funds should not be mixed with the organizer’s personal funds. An oral promise makes it harder to deal with a death, dispute or lost device.

Do not accept deposits while promising a return simply because an initial investment appears to be working. A fund-raising and intermediation activity must be classified before other people’s money is mobilized. Initial financial success is not authorization and does not guarantee payment continuity.

A professional file therefore requires more than a list of available tokens. Contracts, partners, control mechanisms and recourse rules must be reviewed together. Involve qualified counsel and the relevant authority before announcing a service to the public.

Request useful confirmation and handle disputes properly

A well-formulated request specifies the place of residence, role, product, source of funds and intended channel. Ask for the references supporting the response. A concrete question increases the chances of obtaining usable evidence rather than a generic commercial message.

Keep responses, texts and terms together with their dates. If an authorization decision is cited, compare its holder with the company named in the contract. A difference in names may have an explanation, but it must be documented before the evidence can be considered sufficient.

In a dispute, first identify the contractual party responsible and the official procedure. A blockchain explorer may confirm certain movements without determining a party’s civil identity or the competent jurisdiction. A technical complaint and a legal process do not necessarily follow the same path.

Refuse to pay for supposed regularization solely at the request of a private contact. A genuine tax or formality must have a verifiable reference, beneficiary and procedure. A threat of permanent blocking does not eliminate the need for these checks.

The question “legal crypto in Burundi” therefore calls for distinctions, not a reassuring slogan. Historical notices, the 2025 reform and individual authorizations must be examined separately. Without relevant confirmation, suspend the commitment and seek local advice rather than treating technical access as an assumed legal right.
