The right question concerns a specific transaction: who receives the money, to provide which service, under what status and with what remedies? This guide distinguishes verifiable rules, provider oversight and personal checks. It does not replace legal advice tailored to a business activity or dispute.
In brief
- Law No. 30/X/2023 and Aviso No. 2/2024 are official references for virtual-asset services.
- Registration for anti-money-laundering purposes guarantees neither invested capital nor the quality of a token.
- A company’s status, activities and contractual terms must be checked separately, using dated evidence.
Legal crypto in Cape Verde: start with the service involved
The term crypto covers very different activities. Our method for checking platform statuses in Africa explains why a serious assessment starts with the provider and its activity, not the logo it displays. Buying an asset for yourself is not the same as holding the keys to several clients’ assets or arranging conversions on their behalf.
The Bank of Cabo Verde lists Law No. 30/X/2023 of June 21 as the legislation governing the provision of services involving virtual assets and the establishment of digital banks. This reference is enough to reject the claim that no framework covers the sector. It does not, however, answer every commercial or tax question.
To assess an offer, describe the flow of funds in a complete sentence. For example: a company receives escudos in its account, buys an asset and then credits a balance that it holds for the client. Each verb points to a function that needs examining. Calling this arrangement simple assistance does not necessarily change its actual nature.
The same reasoning applies to messaging groups. Someone who shares information does not automatically become a professional. Conversely, a person who regularly handles other people’s funds for payment should not rely on the label “community” to avoid examining their obligations. Frequency, organization, responsibilities and clientele all matter to the classification.
We have not established an exhaustive, up-to-date list of registered providers here. No commercial name therefore receives implicit approval from this article. For a specific service, request the exact legal name and check its status with the competent authority rather than inferring authorization from its online presence.
Understanding what registration actually covers
In its June 7, 2024 statement, the central bank explains the role of Aviso No. 2/2024: organizing registration and supervision for the prevention of money laundering and terrorist financing. The stated objective therefore covers a specific area. It should not be expanded into a public guarantee against market losses.
The Aviso notably distinguishes exchanges between virtual assets and currency, exchanges between virtual assets, transfers on behalf of clients, and the custody or control of keys. These categories show why a single certificate displayed in an advertisement does not answer every question. The service being sold must match the scope actually covered and the entity concerned.
An authentic document may still be insufficient. It could concern another company in the group, another jurisdiction or a different activity. Check the full name, reference, date and scope of the document. If the seller refuses to provide these details while insisting that you pay urgently, you have a concrete reason to stop the transaction.
Identity checks do not prove authorization either. Our guide to KYC, data and remedies distinguishes a due-diligence obligation from a trust label. A fraudulent website can still request an identity document. Before sending anything, identify the data controller, the official channel and the purpose of the collection.
Finally, supervision does not eliminate technical risk. A platform may suffer an attack, a management error or a withdrawal outage. Regulatory status and operational capacity answer two different questions. A prudent decision requires evidence on both points, without turning partial proof into a general guarantee.
Distinguishing investment, payment and repayable deposits
Holding a digital asset does not automatically give it legal-tender status. The Aviso itself presents a virtual asset as distinct from a currency that has that status. Avoid reasoning such as, “A framework exists, so every merchant must accept Bitcoin.” An acceptance requirement cannot be inferred from legislation organizing providers.
A bank payment made by phone is another matter altogether. The interface may move escudos between accounts without delivering any virtual asset. Proof of the debit confirms a monetary transaction, not an acquisition on a blockchain. Our guide to buying crypto with mobile payments explains why the payment recipient and the expected delivery must be checked separately.
Promises to repay principal require particular attention. In an alert dated September 29, 2025, concerning OPTCOIN, the BCV reported an offer to receive repayable funds without prior authorization. The document stated at the time that the entity had neither authorization nor registration. This historical warning is not an up-to-date check of any subsequent situations involving it.
The lesson extends beyond that name: a company that takes money while promising to repay it may raise financial questions distinct from the simple sale of a token. Adding the word blockchain to the offer does not resolve those questions. Demand a clear classification of the product, and do not confuse registration for one activity with authorization to collect every form of funds.
Advertising must also be read alongside the contract. An advertised rate may conceal a loan, exposure to counterparty risk or conditional remuneration. Ask who is actually required to return the capital and under what circumstances. If nobody can answer without referring only to the token’s growth, the repayment mechanism lacks a verifiable basis.
Building evidence before transferring funds
A useful personal file can consist of a few consistent documents: the time-stamped offer, the applicable contract, the counterparty’s identity, the total amount and proof of delivery. Keep them in a private, backed-up location. An isolated screenshot without a date, entity name or context leaves more room for dispute.
Next, compare the advertised benefit with the actual risk being taken. In an entirely fictional example, a seller promises to return 12,000 CVE after receiving 10,000 CVE for one month. The advertised gain is 2,000 CVE, or 20% over the period. This calculation describes only the commercial promise; it proves neither feasibility nor legality.
Ask for the economic explanation behind the return, the loss scenarios and the withdrawal conditions. An initial payment of a few interest installments does not prove that an activity is sound. It may come from temporary reserves or new deposits. The file should make it possible to understand the source of the income without relying solely on testimonials or a dashboard controlled by the seller.
Fees require the same level of precision. Our method for calculating the full cost of a crypto purchase includes the price spread, withdrawal and conversion into local currency. An expensive product may still be contractually transparent; an attractive price may instead conceal an untraceable recipient. Do not confuse competitiveness with legality.
For custody services, ask who can authorize a transfer. If the service controls the keys, your access depends on its systems and rules. If you control them, you are responsible for backups and address errors. Understanding how a crypto wallet works helps prevent attributing to an authority protection that the architecture does not provide.
What to do when in doubt without making matters worse
Before starting a professional activity, have the arrangement reviewed by a qualified local adviser. Present a precise structure rather than an abstract question about crypto. The role of each company, the countries involved, who holds the funds and how remuneration works will produce a more useful answer than a general formula found on social media.
Taxation requires its own verification. Regulation of providers does not amount to an exemption for individuals or companies. Keep acquisition prices, fees, dates and conversion records. For a tax filing, consult the competent administration or a professional; no specific crypto tax rate for individual situations was confirmed in this research.
If a seller blocks a withdrawal, stop making additional payments and gather the existing evidence. Do not pay a supposed unlocking tax sent to a private wallet without independent verification. Contact support through the official website, then approach the relevant parties according to the nature of the dispute. A complaint does not guarantee recovery, but an organized file makes the facts easier to understand.
Avoid publishing identity documents, security codes or unsubstantiated accusations against named individuals or companies. A complaint should distinguish observed facts from suspicions. Record precisely the initial request, the payment made, the service promised and the response received. This timeline will support your efforts better than an accumulation of emotional messages that are difficult to use.
Cape Verde’s framework provides real reference points, not general approval of the market. A reasonable decision means linking each piece of evidence to the question it answers: the entity’s status, the activity covered, the contract, the risk and the available remedies. Until an essential link is established, suspending the transfer costs less than placing trust that cannot be justified.
