Crypto Regulation in Libya: Assessing Each Activity

Crypto regulation in Libya must be assessed activity by activity. Software development, custody, mining and foreign exchange are different businesses, even when they all use the word blockchain.

Crypto regulation in Libya must be assessed activity by activity. Developing software, holding assets for others, operating a mining facility and offering foreign-exchange services are not the same business, even when they all use the word “blockchain” in their descriptions.

For a company, the challenge is therefore not to find a reassuring quotation, but to build a map of its obligations and supporting evidence. This guide sets out that method without certifying any local license, providing an exhaustive list of rules currently in force or turning a translation of legislation into legal advice.

In brief

  • The evidence must connect a specific activity, a responsible person and the scope of the authorization.
  • A payments or foreign-exchange license does not automatically cover an additional crypto service.
  • Costs, personal data and incident handling must also be included in the file.

Crypto regulation in Libya: map the flows before applying labels

The method based on platform status and criteria is a useful starting point: who contracts with the customer, who receives the funds and who holds the assets? These questions often reveal more than terms such as “fintech,” “partner” or “technology provider.”

A flow chart should show inflows, conversions, transfers, accounts and outflows. It should specify who can block or move the funds and who charges for each service. An intermediary that presents its activity as simple support may nevertheless perform a broader role depending on what it actually does.

The business model requires the same precision. A fixed fee for software, a commission on transfers and a margin on foreign exchange do not describe the same service. Contracts, commercial interfaces and actual operations must remain consistent. A clause stating that the provider never holds funds is not enough if, in practice, it controls the customer’s access.

In Libya, reports of the central bank’s restrictive position in 2018 represent a serious warning. We did not locate the original statement in the official pages reviewed and therefore do not certify any current list of permitted activities or sanctions. The project must be reviewed locally before implementation.

Classify texts and evidence by function

A law establishes a framework; a regulation may specify how it is applied; a license applies to a holder and a defined scope; and a contract organizes a commercial relationship. These documents do not answer the same question. Placing them all in a single “official documents” category encourages mistakes when the time comes to demonstrate the right to operate.

The reproduction of Libyan Law No. 6 of 2022 provides an instructive example. Its provisions on electronic transactions and electronic money help identify the issues that need to be examined. For this guide, however, they do not prove that a private company can market any token to Libyan residents.

This documentary source is a translation, not a certification by BrefCrypto that it reflects an officially consolidated version. For a project involving capital or customers, local counsel should verify the applicable version, related texts and any sector-specific requirements. Quoting an article without its definitions can lead to a conclusion that is too broad or entirely misplaced.

The file should retain the source address, the date it was consulted and the exact nature of the document. Historical statements reported by Libya Observer retain their secondary attribution. An internal note should clearly distinguish confirmed points, proposed interpretations and questions that remain open, so that a colleague does not turn a hypothesis into an authorization.

Separate payments, foreign exchange, custody and mining

A payment system executes settlements according to its own rules. A foreign-exchange service converts monetary units within a defined scope. A custodian controls or holds access credentials on behalf of a customer. Mining uses equipment and energy to participate in a network mechanism. None of these roles automatically covers the others.

The official presentation of LYPay describes an instant payment service between Libyan banks. The existence of person-to-person transfers does not demonstrate the existence of a crypto marketplace. Using the same P2P acronym for two different services creates neither a partnership nor permission to convert dinars into privately issued digital assets.

Custody deserves particular attention. Our guide to crypto wallets and keys shows that technical control may remain with the provider or the user. A professional who holds the means to spend assets on behalf of others must have that responsibility properly classified; describing it as technical assistance does not make it disappear.

For mining, the questions may also involve the right to use the premises, electricity, equipment imports and the activity being conducted. This guide does not establish their detailed content. It simply recalls that an analysis based solely on the Bitcoin protocol would overlook some of the facts. A court decision concerning a specific facility does not justify inventing a universal penalty for every crypto use.

Organize identity, data and traceability without going too far

Collecting large numbers of documents does not guarantee compliance. It is necessary to know why each piece of data is needed, who can access it and how it will be protected. A customer file containing an identity document, access codes and unfiltered bank screenshots creates a particularly sensitive target if internal permissions or devices remain poorly secured.

The guide to KYC and user recourse distinguishes customer identification from provider verification. The two controls are not interchangeable. A team should not cite a KYC form as proof of its own right to operate, nor request cryptographic secrets to satisfy an ordinary documentary requirement.

An actionable record includes the economic purpose, the parties, the date, the amount, the reference and the relevant documents. A blockchain transaction ID may supplement the file, but it does not by itself certify the actual beneficiary or the justification for the flow. Bank payment information and asset information must remain reconcilable without exposing sensitive data.

Retention periods and reporting obligations depend on the rules applicable to the activity. We do not establish a universal Libyan regulatory deadline here. An internal policy should result from a professional review and also provide for handling legitimate requests, securing backups and responding to a breach. Copying a foreign policy without adapting it may create further inconsistencies.

Test the business model against a plausible incident

Commercial presentations focus on successful transactions. A serious analysis also considers a suspended withdrawal, an incorrect destination, a requested refund or an investigation into the origin of funds. It must determine who responds, which documents serve as evidence and how the customer receives understandable information while the matter is being handled.

Our method for calculating the full cost of crypto operations distinguishes gross revenue, commissions paid out and the costs actually incurred. A project that overlooks incidents may show an attractive margin while depending on unavailable cash. The compliance and security budget should not disappear beneath a promise of automation.

Consider an internal simulation, with no real pricing: an activity charges 20 dinars for each of 30 monthly cases. Its gross revenue reaches 600 dinars. If its fixed and variable costs total 720 dinars, it loses 120 dinars before any unexpected expense. This calculation does not recommend the activity; it shows why stated volume and margin are not enough.

The scenario should also provide for a complete interruption. Who keeps the archives? How are customers informed without exposing their data? Which payments remain pending? An orderly wind-down procedure offers more protection than a vague clause stating that the company is never responsible for technical problems. The contract must be reviewed against the applicable rules, not merely the provider’s wishes.

Update the file without claiming absolute compliance

Any potential authorization has a scope and conditions. Adding a new currency, counterparty, country or custody function may change the project. Documentary review must therefore track product changes rather than remain frozen at the date the company was created or the website was published.

The principles of mobile payments and service separation help identify these changes in scope. An authorized payment provider does not guarantee every activity of a merchant using its services. A technology agreement does not replace an assessment of any financial activity ultimately provided to the end customer.

Governance can take a simple form: a decision register, a person responsible for each verification, the date of the next review and a list of blocking issues. Unanswered questions should prevent the relevant service from launching, not disappear from a document intended for partners. A company should never sell a compliance certification it does not possess.

Someone outside the project can review the flow chart and try to link each payment to its contract. If they cannot do so, the file is probably not clear enough. This simple check can identify gray areas before a customer or partner discovers them during an incident.

For Libya, the conclusion remains a working method, not regulatory validation: define the flows, classify the sources, identify each role and obtain the relevant local confirmations. Until an essential link is in place, the project should not be presented as ready to operate. This discipline protects customers as well as the team that would bear responsibility for the operations.
